We take your privacy seriously!

As most people are now familiar with, the EU has decided to introduce new data protection regulations (GDPR). The new rules apply in large parts of Europe from 25 May 2018.

Privacy statement:

Personal information is information that can be linked directly to you as a person, for example name, e-mail address and company name. Such information is necessary for us to be able to serve you as a customer.

Purpose:

The purpose of our processing of your personal data is to identify you as a customer, and fulfill the agreement you have with us. Our processing of personal data is handled by our skilled employees.
The personal information is processed by BIKS AS.

All employees of BIKS AS are subject to a duty of confidentiality. The duty of confidentiality applies not only outside the company, but also internally between colleagues, and lasts even if the employment relationship has ended.

What personal data is processed:

  • • Administrative information, such as name, date of birth, address, mobile number, e-mail address, and which company you work for
  • • Information about completed courses at BIKS AS
Valid grounds for processing:

We only collect information about you in order to send you relevant information that you yourself request. We never collect and store your information without your consent, and never use the information for anything other than what we have stated. If we have to process sensitive personal data in order to fulfill an agreement with you, we will obtain your consent to this in advance of the processing. The consent limits the processing to only include the information that is necessary for BIKS AS to be able to fulfill the specific agreement. You can withdraw your consent at any time. The processing of the relevant personal data will then cease.

Disclosure of personal data:

Personal data may be disclosed to public authorities, if this follows from a statutory obligation to provide information or a duty to disclose.

All third parties who receive personal data from us are subject to confidentiality by entering into an agreement. BIKS AS never gives out or sells personal data (e.g. mailing lists) to external companies without the person's consent.

Storage:

BIKS AS does not store personal data longer than is necessary to fulfill the purpose of the processing. If you have a customer relationship with us, personal data will be stored about you. All information about you is stored on secure servers, in line with defined security procedures.

Right to demand access:

You have the right to demand access to the information we process about you. You have the right to know which purpose and processing basis we use, which information about you we process, recipients or categories of recipients to whom the personal information is passed on, the storage length of the personal information, and where the information is obtained from.

Right to demand correction and deletion:

If you believe that BIKS AS has recorded information about you that is inaccurate or incomplete, you have the right to demand correction of the relevant personal information. You can demand that we delete personal information about you, if the information is no longer necessary to fulfill the purpose of the processing. You withdraw your consent if it is consent that has been used as a basis for processing, you oppose the processing and there are no other overarching legitimate reasons for continuing the processing or that the information has been processed illegally.

Right to data portability:

You have the right to receive personal data we have stored about you in a structured, commonly used and machine-readable format. You also have the right to demand that we transfer information we have received from you to another controller if it is technically possible and the processing is based on consent or contract.

Complaint about the treatment:

The Norwegian Data Protection Authority's job is to check that the privacy regulations are followed. If you experience something that you believe is a breach of the regulations, you can submit a written inquiry to the Data Protection Authority's postal address: Data Protection Authority, PO Box 8177, 0034 OSLO.

Terms of purchase

General information

BIKS AS complies with the Norwegian Electronic Commerce Act, the Norwegian Cancellation Act and the Norwegian Consumer Purchases Act, and other laws that regulate the enterprise. The website biks.no is owned and operated by BIKS AS, Org. No. 986 323 619.

Right of cancellation

Enrolment in online courses is binding once the purchase has been confirmed by enrolling on the seller’s website. When purchasing online courses with BIKS AS, the Norwegian Cancellation Act applies in its entirety. The buyer has a 14-day full right of return. Upon enrolment, a username and password will be sent for login to the online course, six days before the course commences.

The right of cancellation expires when the buyer chooses to use the online course, i.e., upon initial login to the online course. The buyer must personally cover the return costs, and the item must be undamaged. The notice from the buyer to the seller on invoking the right of cancellation should, for evidential reasons, be in writing (right of cancellation form, e-mail, or letter), and it must contain information about how the buyer will return the product to the seller.

When invoking the right of cancellation, the product must be returned to the seller within a reasonable period of time. The Seller is obliged to refund the full purchase price to the Buyer within 14 days from the day the Seller receives the product or collection note or the product is made available to the Seller. Upon enrolment, the buyer is immediately sent a right of right of cancellation form.

All prices are in NOK. An invoice fee of NOK 100 is added in case of payment using invoice. The general due date is 14 days. There is no invoice fee for purchases made using a card. The prices stated in the online shop include shipping and valued added tax. An order confirmation is displayed on the screen, as well as automatically sent by e-mail immediately to the buyer. The buyer is urged to check if it is correct. In case of errors, the buyer should contact the seller as soon as possible.

Delivery, etc.

The product is considered delivered when the username and password for personal login are received. This is sent by e-mail six days before the course commences. Payment by VISA/MasterCard is therefore charged immediately. (Invoices are also normally issued immediately, with a 14-day due date.) The courses are designed for use on PC/Mac and can also be used on tablets and mobile phones. BIKS AS strives to ensure that the online courses work as well as possible on as many platforms as possible, at all times. However, browsers and operating systems are updated frequently, entailing that some minor errors may occur for periods before we can rectify the errors.

Defects/complaints

The Buyer is urged to check that the package of materials is in accordance with the order, and whether it has been damaged or if it is otherwise defective. In the event of defects in the contents/complaints regarding the package of materials, notice must be given to the seller as soon as possible, and no later than two months after the package is received. The notice should be in writing. General complaints regarding the product are applicable two years from the purchase date. If the product is paid for by credit card, the buyer may also choose to complain and send claims directly to the credit provider (the credit card company).

Misuse

The buyer of the online course is assigned a username and password for personal login. The password for the online course is strictly personal and it is not permitted to share user/password with others. In case of multiple individuals in the same household, several accesses must be ordered. A discount will then be applied. Misuse may result in suspension from the course without any compensation. It is illegal to copy from the course. Displays of animations, videos or the course in general to others without approval will result in reporting to the police.

Access, network problems, exam registration

The buyer is given access to the course for a specified period which is selected at the time of purchase. Access to the online course is effective from the date of purchase. The e-learning course must be commenced within four months of the registered order and will be available for seven weeks after start-up. The Seller is not liable for circumstances beyond the Seller's control, such as network problems and the like.

Acceptance of terms and conditions

By ticking the box “I accept the terms and conditions and the rules governing de-enrolment” in the enrolment form on our website, it is assumed that these terms and conditions have been read and accepted by the buyer. To register an enrolment with us, you must be at least 18 years of age. If the buyer is younger than 18 years of age, the parent/guardian must make the enrolment.

Processing of personal data

All personal data provided upon enrolment is stored in the company's databases. Personal data is not forwarded to third parties. Upon enrolment/registration for the online course, the buyer accepts that the seller's computer system automatically registers screen resolution, type of browser, operating system and IP address. The information is stored securely together with other personal information and will be used in statistics and for problem solving/technical support for the buyer. Activity in the course is also saved automatically. (Time logged in, number of logins, results on tasks and the like). This information is used for statistical purposes in order to continuously improve the course.

The Buyer has the right to request access to the data that is registered about the Buyer.

The buyer may view his/her personal data under “My page” when he/she is logged in. The buyer may also access such data, as well as have the data erased, by contacting BIKS AS in writing by e-mail or ordinary post. (See contact information at the bottom).

Buyer's rights in case of delay

If the seller does not deliver the product or delivers it too late in accordance with the agreement between the parties, and this is not due to the buyer or circumstances on the part of the buyer, the buyer may, according to the rules in the Chapter 5 of the Norwegian Consumer Purchases Act, withhold the purchase price, demand fulfilment, cancel the agreement and demand compensation from the seller.

Buyer's rights in the event of defects

If the product has a defect and this is not due to the buyer or circumstances on the part of the buyer, the buyer may, according to the rules in the Chapter 6 of the Norwegian Consumer Purchases Act, withhold the purchase price, choose between rectification and redelivery, demand a discount, demand cancellation of the agreement and compensation from the seller.

Seller's rights in the event of buyer's default

If the buyer does not pay or fulfil the other obligations under the agreement, and this is not due to the seller or circumstances on the part of the seller, the seller may according to Chapter 9 of the Norwegian Consumer Purchases Act, depending on the circumstances, withhold the product, demand fulfilment of the agreement, demand cancellation of the agreement and compensation from the buyer. The seller may also, depending on the circumstances, charge interest in the event of late payment, collection fees and fees for non-prepaid uncollected products.

Company courses

For company courses/courses for groups and group enrolment for online courses, the enrolment is binding from the time the participant list is sent to BIKS AS. This is considered a binding contract in accordance with the agreed purchase price in the offer. The company's name and logo can be used by BIKS AS in marketing/as a reference.

In-class courses

Enrolment with BIKS AS is binding from the moment you enrol. The courses have a limited number of places and we make reservations that there is space available, and that the course has a sufficient number of participants to commence. We also reserve the right to make changes in the course description, syllabus, course venue and start-up date. Furthermore, we make reservations regarding conditions that are not under our control (e.g., weather conditions, strikes etc.). We also reserve the right to change fees for exam fees determined by parties other than BIKS AS.

De-enrolment from in-class courses

If, after having enrolled in an in-class course, you are prevented from participating, you must as soon as possible send written notice (post or e-mail) to the addresses noted at the bottom. For de-enrolment, please see the de-enrolment details on the enrolment from

  • • The full course fee is payable in case of cancellation after the course has commenced, no-show for the enrolled course, or discontinuation of a commenced course.
  • • In the event of documented illness or other precarious events that were impossible to foresee, no cancellation fee will be payable and the course fee will be refunded in full. Example of medical certificate.
  • • Course fees that have been paid for courses that do not commence are refunded in full.

Right of withdrawal

BIKS AS follows the e-commerce act, the right of withdrawal act and the consumer purchase act, and other laws that regulate the business. The BIKS AS website is owned and operated by BIKS AS, Org. No. 986 323 619.

The consumer has the right to withdraw from the agreement (right of withdrawal) by giving notice to the trader before the expiry of the withdrawal period, cf. § 21. The withdrawal period is deemed to have been complied with if notification is sent before the expiry of the period.

Registration for an online course is binding when you confirm the purchase by registering on the seller's website. When purchasing an online course from BIKS AS, the Right of Cancellation Act applies in its entirety. The buyer has 14 days full right of return. When registering, a username and password for logging in to the online course will be sent 6 days before the start of the course. The right of withdrawal expires when the buyer chooses to use the online course, i.e. upon first logging into the online course.

The buyer must cover return costs themselves, and the item must be undamaged. The message from the buyer to the seller about using the right of withdrawal should be in writing (right of withdrawal form, e-mail or letter) for reasons of proof, and it must contain information on how the buyer will return the goods to the seller. When using the right of withdrawal, the goods must be returned to the seller within a reasonable time. The seller is obliged to repay the entire purchase price to the buyer within 14 days from the day the seller receives the item or collection note or the item is placed at the seller's disposal.
